Josephine County Oregon Sheriff Gil Gilbertson standing up for the miners Rights

Hal Anthony minnig law researcher/speaker, David McAllister President of the Southwest Oregon Miners Association, Ron Gibson Vise President of the Southwest Oregon Miners Association and a number of media had a sit-down with Josephine County Oregon Sheriff Gil Gilbertson this last Friday (09/25) to discuss the Miner's Right to those minerals conveyed in the 1866 Grant. After the law (1866 Grant) and state and federal statutes that say there is not to be ANY interference in what the miners have a lawfull Right to, and do, was shown to Gilbertson, he stated until he could find that what was presented to him to be incorrect, he was going to instruct his deputies not to interfere with the miners and thier work and that memo was going to BLM and Forest Service aswell.

OH, and by the way, Gilberson has said he will be at this Fridays (10/02) Miners meeting at Pottsville.

US CODE TITLE 16 CHAPTER 28—WILD AND SCENIC RIVERS

Regulations issued under the WSR Act (16 USC 1271 et seq.) establish the procedures by which the designated wild and scenic rivers will be managed. The full suite of regulations issued by the U.S. Bureau of Land Management (BLM) under this Act is available at 43 CFR 8351. http://www.law.cornell.edu/uscode/16/usc_sec_16_00001280----000-.html § 1280.

Federal mining and mineral leasing laws (a) Applicability to components of system

Nothing in this chapter shall affect the applicability of the United States mining and mineral leasing laws within components of the national wild and scenic rivers system except that—

[Question: What part of NOTHING SHALL AFFECT is there to misunderstand?]

(ii) subject to valid existing rights, the perfection of, issuance of a patent to, any mining claim affecting lands within the system shall confer or convey a right or title only to the mineral deposits and such rights only

(iii) subject to valid existing rights, the minerals in Federal lands which are part of the system and constitute the bed or bank or are situated within one-quarter mile of the bank of any river designated a wild river under this chapter or any subsequent Act are hereby withdrawn from all forms of appropriation under the mining laws and from operation of the mineral leasing laws including, in both cases, amendments thereto.

(b) Withdrawal from appropriation of minerals in Federal river beds or bank areas; prospecting, leases, licenses, and permits

of section 1276 (a) of this title are hereby withdrawn subject to valid existing rights, from all forms of appropriation under the mining laws and from operation of the mineral leasing laws including, in both cases, amendments thereto, during the periods specified in section 1278 (b) of this title. [§ 1278. Restrictions on water resources projects (b) Construction projects on rivers designated for potential addition to system (i) during the ten-year period following October 2, 1968, or for a three complete fiscal year period following any Act of Congress]

ORS 517.128 Restricting access to open mining area or mining claim prohibited. A person may not attempt to restrict access to any open mining area or valid mining claim or to harass or interfere in any way with a person engaged in lawful mining activities. [1999 c.354 §4] (3) Interfering with a mining operation is a Class C misdemeanor. [1999 c.354 §6]
